Terms and Conditions
Version 1.0 — effective from the official launch of Strainwall
1. Purpose
These Terms and Conditions govern transactions between users (buyers and sellers) on the Strainwall platform, a P2P marketplace dedicated to collectors of seeds, pollen, cuttings, tissue culture, and horticultural equipment.
2. Strainwall status — technical intermediary
Strainwall acts exclusively as a technical intermediary between users. Sales contracts are concluded directly between the buyer and the seller. Strainwall is not the seller of listed items and cannot be held liable for the contractual obligations of the parties to the transaction.
3. Service fees
Each transaction incurs buyer fees of €0.50 + 6% of the item amount (excluding fees). These fees are clearly displayed before any payment and are included in the total amount charged.
4. Escrow mechanism
Funds are held in escrow until the buyer confirms receipt, within documented timeframes: EU D+14 · Americas D+21 · International D+28 after shipping. In the absence of tracking after D+10 (seeds/TC) or D+15 (equipment), an automatic refund may be triggered. The escrow protects both parties and cannot be bypassed.
5. Seller obligations
The seller agrees to: (i) ship the item within 5 business days of payment confirmation; (ii) provide a valid tracking number; (iii) accurately describe the item; (iv) comply with the Strainwall Seller Charter.
6. Buyer obligations
The buyer agrees to: (i) confirm receipt upon delivery; (ii) open a dispute within the protection period if a problem arises; (iii) not abuse the dispute process. The buyer is solely responsible for verifying the legality of importing and using the acquired products in their country of residence. Strainwall cannot be held liable for any consequences arising from use that does not comply with the buyer's local legislation.
7. Disputes
In the event of a dispute, the buyer may open a case via the platform. Strainwall reviews the case and issues a decision within 72 business hours. Strainwall's decision is final within the scope of the escrow mechanism. Legal remedies remain available.
8. Prohibited items
The following are prohibited on Strainwall: any regulated substance, any plant material intended for consumption, any counterfeit goods, any propaganda material. Non-compliant listings are removed without prior notice.
9. Applicable law
These Terms and Conditions are governed by French law. Any dispute falls under the jurisdiction of the competent courts at Strainwall's registered office.
10. Amendments
Strainwall reserves the right to amend these Terms and Conditions. Users are notified by email. Continued use of the platform after notification constitutes acceptance.
11. Nature of products — collectible items
Products available on Strainwall are sold exclusively as collectible items for genetic preservation. Strainwall does not in any way encourage germination or cultivation outside jurisdictions where it is explicitly permitted. Any use of products for purposes other than collection is the sole responsibility of the buyer, who must ensure compliance with applicable legislation in their jurisdiction.
12. Minimum age
Access to Strainwall is restricted to persons aged 18 and over. By using the platform, the user declares they have reached this age. Strainwall reserves the right to suspend any account for which a legitimate doubt about the user's majority is raised.
